Applying for ILR on a 10-Year Basis

Applying for ILR based on a 10-year continuous lawful residence can be complex. You must meet several eligibility requirements to qualify:
  • Current Leave to Remain: You should currently have leave to remain in one of the UK immigration categories.
  • 10-Year Continuous Lawful Residence: You must have lawfully lived in the UK for 10 consecutive years.
  • English Language Skills: You must pass the Life in the UK Test and demonstrate sufficient English language skills.
  • Compliance with Immigration Laws: You should not have breached any immigration laws and must have maintained the terms of your UK visa.
  • No Public Interest Reasons: There should be no public interest reasons that would make it undesirable to grant you ILR.

Continuous 10-Year Lawful Residence

During the 10-year period, you must ensure:
  • You have not been outside the UK for more than 18 months (540 days in total).
  • You have maintained valid leave to remain under any immigration category.
  • You have not been outside the UK for more than 6 months on any single occasion.
  • Your departure from the UK did not demonstrate a clear intention or evidence of not returning to the UK.
  • You have not left the UK with a refusal of leave to enter or remain.
  • You have not been removed or deported from the UK.

English Language Requirements for ILR on a 10-Year Basis

To meet the English language requirements for ILR based on 10 years’ residence, you can:
  • Obtain a speaking and listening qualification at B1 level.
  • Hold a degree-level qualification taught or researched in English.
  • Be an original national of an English-speaking country.

Excess Absences for 10-Year ILR Application

If your absences exceed 540 days during the 10-year period, the Home Office may exercise discretion based on specific circumstances:

  • The Home Office considers when the long absence(s) occurred and how soon you can meet the requirement.
  • Compelling reasons, such as unavoidable circumstances preventing your return to the UK, may be considered.

Subject Access Request (SAR) for 10-Year ILR Applications

If you have insufficient records of absences from the UK, you can submit a subject access request to the Home Office to assist in preparing a complete list.

When to Apply for 10-Year ILR?

You should apply for ILR before the expiry of your current leave to remain, but not more than 28 days before completing the 10-year qualifying period.

Documents Required for ILR 10-Year Application

For a valid ILR application based on 10 years, you will generally need:

  • Current Passport or valid travel ID
  • Biometric Residence Permit (BRP) if applicable
  • Two identical passport size color photographs
  • Police registration certificate (if applicable)
